General terms and conditions for participants
The prize competition takes place March 2019 – November 2019. No purchase or donation necessary. Void where prohibited. A purchase or donation will not increase your likelihood of winning.
The competition is open to HVAC-R industry professionals over the age of 18 years from worldwide. The competition is not open to the Danfoss employees and their family.
The players have one chance to win each month for a completed Coolselector®2 Challenge posted on Danfoss social media channels. Completing the Challenge correctly more than one time will not change your winning chances. Entering the competition requires acceptance of Danfoss Privacy Policy and these Terms of competition.
Each monthly Challenge will run from 00:01 on the first day of each month to 24:00 of the last day of the calendar month (Danish Time).
Selection of winners and notification
Each winner will be randomly drawn among anyone with a correct answer and be contacted directly via the email address provided when registering for the prize competition. Normally first drawn winner will be contacted by email within 2 working days after expiry of each monthly Challenge. Please check your spam filter! We are not responsible for any delay due to your spam filters. After being notified of the prize, the winner has 72 hours to respond to the email notification and accept the prize. Should this not happen, the winner will lose the right to the prize, and a new winner will be drawn. If no-one claims the prize, the prize will not be awarded. The winner bears the risk relating to Danfoss receiving their acceptance of the prize within the 72 hours. By taking part in the prize competition, you accept these Terms.
Award and publication of winner
Winners will be requested to send their name, their address (for delivery of their prize) and an image of themselves and their prize to be used on Danfoss social media channels. This image, along with the winner’s name will be published on social media in connection with the notification of the monthly publication of the challenge winner, unless the winner explicitly requests otherwise. Danfoss will only use the information and picture for this purpose. Sending a photo and your consent to such being published with your name is voluntary and not a requirement for being awarded a prize.
Danfoss reserves the right to verify any winner’s compliance with the participation requirements. If you cannot reasonably document such compliance on Danfoss request, Danfoss may disqualify you as a winner and a participant in the Challenge, and a new winner will be drawn. Danfoss will only use the information provided for this purpose.
Prizes
- Custom action figure (value approx 100 EUR in retail prices). Please note that the custom figure can be made to bear your facial characteristics if you choose to submit a picture of your face according to the requirements of the manufacturer.
One prize will be awarded each month, and in total 6 prizes will be awarded during the Coolselector®2 Challenge. A participant cannot not win more than one prize. The prize cannot be exchanged for cash or other goods. Danfoss retains right to change with different but similar prize if not easily available. The winner’s right to prizes is personal and cannot be transferred to any third party. Danfoss gives no warranty and disclaims any claims regarding the prizes quality, value, defects or otherwise, and grants only such rights of the manufacturer’s warranty as follow the prize products.
Taxation
Danfoss may be asked by tax authorities to disclose the identity of participants and the monetary value of services received. Please note that the prize, depending on national taxation laws, may be taxable. It is the responsibility of the participant to pay taxes on prizes in accordance with applicable taxation laws. Danfoss assumes no obligation to the participants in relation to the transfer of the prizes or the reporting of prizes to authorities. The participant hereby waives all claims against Danfoss in this regard.
Personal data
Personal data provided in connection with the competition will be handled in accordance with current legislation, these Terms and Danfoss Privacy Policy. Personal data provided by participants will only be processed within the scope of the competition as set out above. Personal data will not be processed for other purposes without prior consent by the participants.
Requests about your personal data shall be directed to the below contact information responsible for competition or to Danfoss data protection officer as set out in Danfoss Privacy Policy.
Applicable law and jurisdiction
This Site resides on a server in Nordborg, Denmark. You agree that these Terms and your use of this Site are governed by the laws of Denmark.
You hereby consent to the exclusive jurisdiction and venue of the courts, tribunals, agencies and other dispute resolution organizations in Denmark in all disputes (a) arising out of, relating to, or concerning this Site and/or these Terms, (b) in which this Site and/or these Terms is an issue or a material fact, or (c) in which this Site and/or these Terms is referenced in a paper filed in a court, tribunal, agency or other dispute resolution organization. Danfoss has endeavored to comply with all legal requirements known to it in creating and maintaining this Site, but makes no representation that materials on this Site are appropriate or available for use in any particular jurisdiction. You are responsible for compliance with applicable laws. Any use in contravention of this provision or any provision of these Terms is at your own risk and, if any part of these Terms is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall govern such use.
